Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the mobile application “Plant Identifier – Scan Plant” (the “App”) provided by AZTTY LLC (“we,” “us,” or “our”). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

3. Account Registration

  • You may create an account using your email address.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You agree to provide accurate information and notify us of any unauthorized use.

4. Subscriptions and Payments

  • The App offers premium features through in-app subscriptions managed by RevenueCat and processed via Apple’s In-App Purchase system.
  • Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period.
  • Payments are non-refundable except as required by law. Refunds are handled by Apple (see Apple’s refund policy).
  • Pricing and subscription details are displayed in the App and subject to change.

5. User Content and Conduct

  • When using the App (e.g., scanning plants or saving results), you may generate or upload content such as photos.
  • You retain ownership of your content but grant us a worldwide, royalty-free license to process it as necessary to provide the App’s features (e.g., sending photos to OpenAI for identification).
  • You agree not to:
  • Use the App for illegal purposes.
  • Upload harmful, infringing, or offensive content.
  • Attempt to reverse-engineer or interfere with the App.

6. Third-Party Services

  • The App integrates with third-party services, including:
  • Supabase (authentication and database).
  • RevenueCat (subscription management).
  • OpenAI API (plant identification).
  • Your use of these services is subject to their respective terms and privacy policies (links available in our Privacy Policy).

7. Intellectual Property

  • The App, its content, and features are owned by us or our licensors and protected by copyright, trademark, and other laws.
  • You may not copy, modify, distribute, or create derivative works of the App.

8. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT PLANT IDENTIFICATIONS ARE ACCURATE OR THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.

Important: Plant identifications are for informational purposes only and may not be accurate. Do not rely on the App for identifying poisonous plants, medical advice, or critical decisions. Always consult experts for safety-critical information.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Continued use constitutes acceptance of the updated Terms.
