These Terms of Service (“Terms”) govern your access to and use of TCG Card Scanner – Price Value (the “App”), an iOS mobile application provided by AZTTY LLC (“we,” “us,” or “our”). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

The App is an unofficial tool for scanning, identifying, and tracking Pokémon Trading Card Game (TCG) cards and their estimated market values. This App is not affiliated with, endorsed, sponsored, or approved by The Pokémon Company, Nintendo Co., Ltd., Creatures Inc., GAME FREAK inc., or any of their affiliates or subsidiaries. Pokémon, Pokémon TCG, and all related characters, names, images, logos, card designs, and other content are trademarks or registered trademarks of Nintendo Co., Ltd., Creatures Inc., and GAME FREAK inc.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the App. If you are under the age required to consent to data processing in your jurisdiction, you may only use the App with permission from a parent or legal guardian who agrees to these Terms on your behalf. We do not knowingly allow use by children under 13.

2. Account Creation and Security

  • Optional account creation allows you to save and sync your card collection data across devices via cloud storage.
  • You are responsible for maintaining the confidentiality of your account credentials (email and password) and for all activities under your account.
  • Notify us immediately at business@aztty.com of any unauthorized access or security breach.
  • You may not use the App or create an account for any illegal, fraudulent, or unauthorized purpose.

3. Permitted Use and Restrictions

You may use the App only for personal, non-commercial purposes, including scanning your own cards, viewing estimated values, and managing your personal collection.

You agree not to:

  • Copy, reproduce, modify, reverse-engineer, decompile, disassemble, or create derivative works of the App or any part of it.
  • Use the App to infringe any intellectual property rights, including Pokémon trademarks or copyrights.
  • Transmit viruses, malware, or harmful code.
  • Interfere with the App’s operation or our servers.
  • Scrape, collect, or harvest data from the App automatically.
  • Use the App for commercial purposes (e.g., reselling scanned data or values) without our written permission.
  • Attempt to circumvent any technical measures or access restricted areas.

We reserve the right to suspend or terminate your access at any time for violations of these Terms or for any other reason, with or without notice.

4. User Content and Card Collection Data

  • Any card collection data you add or sync (e.g., card details, quantities, conditions) is your “User Content.”
  • You retain ownership of your User Content but grant us a worldwide, non-exclusive, royalty-free license to store, process, display, and sync it solely to provide the App’s features.
  • You are solely responsible for the accuracy of your User Content and ensuring it does not infringe third-party rights.
  • We do not claim ownership of your User Content and will not use it for marketing or other purposes beyond App functionality.

5. Third-Party Services

  • Card scanning uses OpenAI’s Vision API for real-time image processing. Images are sent transiently to OpenAI and discarded immediately by us. Your use of this feature is subject to OpenAI’s terms and privacy policy (https://openai.com/policies).
  • Estimated card values and other data may come from public sources or third-party APIs. We do not guarantee accuracy, timeliness, or availability.
  • The App relies on internet connectivity and third-party services; we are not responsible for interruptions or failures caused by them.

6. Intellectual Property

  • The App, its design, code, features, and any original content (excluding Pokémon-related material) are owned by AZTTY LLC and protected by copyright, trademark, and other laws.
  • You receive a limited, non-transferable, revocable license to use the App on your iOS device(s) solely as permitted by these Terms.
  • All Pokémon-related content displayed is for identification and reference only and remains the property of its respective owners.

7. Disclaimers and No Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be error-free, secure, or uninterrupted.
  • Card values or identifications will be accurate (market prices fluctuate; use at your own risk).
  • The App will meet your requirements.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AZTTY LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the amount you paid us (which is zero, as the App is free with no subscriptions or purchases).

9. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms, your User Content, or your use of the App.

10. Termination

You may stop using the App at any time. We may terminate or suspend your account or access for any reason, including violations of these Terms. Upon termination, your right to use the App ends immediately, and we may delete your synced data.

11. Changes to Terms

We may update these Terms occasionally. We will post the revised version with an updated effective date. Continued use after changes constitutes acceptance. For material changes, we may provide in-app notice.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of United States, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts located in Wyoming, United States.
